As per the directives of the Ministry of Women and Child Development and in pursuance of Sec 80 and Sec 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015, the Social Welfare Department (SWD) has notified all responsible that adoption can be taken place only through the due process of law.
In a notification, the department stated that direct adoption of children from hospital, nursing homes, and maternity homes by/through person in-charge, including employees or any other person without following the procedures was a punishable offence.
It also cautioned that if any person or organization offers or gives or receives, any orphans, abandoned or surrendered child for the purpose of adoption without following the provisions or procedures as provided in the Acts, such person or organization shall be punishable with rigorous imprisonment upto seven years and also be liable to a fine of Rs.1 lakh.
