Department of Justice & Law has notified that affidavit in the Lokayukta has to be filed in the same way as documents were filed in the proceedings before the High Court and the Supreme Court.
It has been noted that the departments were not acquainted with the procedures to be followed in the matters pending and filed before the Lokayukta, particularly on account of absence of Rules to be framed by the State Government in consultation with the Lokayukta. As such, they do not refer the matter to the Department of Justice & Law for legal advice and vetting.
Therefore, all such proceedings where the Lokayukta organisation issue notice to the government departments, the department concerned has to refer the files to the secretary, Justice & Law, Nagaland for legal advice and vetting before it was filed in the Lokayukta.
