Gauhati High Court (GHC) Kohima Bench has quashed the interim order of special judge passed on May 29 granting bail to the accused in the molestation case of a minor by her school principal here in April this year.
While cancelling the bail, the court ordered that the accused should be committed to judicial custody for fair trial, though he was granted the liberty to move the special court, POCSO, for bail by filing appropriate medical documents from the medical board. The superintendent of Dimapur Jail was also directed to provide all necessary medical care to the accused.
The 12-paged judgment (oral) stated that the court after having considered all the pleas, had come to the undoubted conclusion that the learned special judge (FTSC) was in error in considering the bail of the accused on the ground of illegal detention and medical ground.
Therefore, the court said that “the impugned order dated 29-05-2021 passed by the learned Special Judge (FTSC) Dimapur is hereby quashed and set aside.”
It may be recalled that the mother of the victim had moved the high court after the special court had granted bail to the accused.
The mother of the victim filed a complaint at the Women Police Station Dimapur on April 7, alleging that her 4-year-old daughter was molested in the school.
Based on the complaint the accused was arrested the same day.
