Kohima district court has convicted four persons in connection with murder of an inspector of the Nagaland police Neiphrietuo Metseio in September 2018.
It may be recalled that the dead body of ABI Neiphretuo Metsieo of 5th NAP ‘C’ Coy Pfutsero, who had gone missing on September 7, 2018 along with his vehicle (Mahindra Scorpio), was found in a decomposed state at a place between Lasumi and Zapami village under Zuketsa circle, Pfutsero sub-division on September 15, 2018. While convicting the accused persons on April 4, 2022, the principal district & sessions judge Y Longkumer stated that the prosecution has proved the case beyond reasonable doubt.
In a statement, public prosecutor (PP) Kohima, T Marlemba said the court further observed that the accused persons did not deserve leniency considering the nature and gravity of the offence. As such, PP said the provision of the Probation of Offenders Act, 1958 was not extended to the accused persons.
The accused identified as Yuireingam R Shimray was sentenced to rigorous imprisonment for 10 years with fine of Rs. 5000 for offence U/S. 304 IPC, in default of payment of fine to undergo another 3 months simple imprisonment, 1 year imprisonment under Section 411 IPC, 1 year imprisonment for offence U/S 465 IPC, 1 year imprisonment for the offence U/S. 34 IPC.
Second accused Rinthingchon Lungharwoshi was sentenced to 3 years 7 months and fine of Rs. 3000 in default of payment of fine to undergo another 3 months simple imprisonment.
Third accused Porhosie Pojair was sentenced to 5 month 10 days and fine of Rs. 5000 in default of payment of fine to undergo another 3 months simple imprisonment for offence U/S. 414 IPC. While the fourth accused Anthony Kapfo was sentenced to 5 months 10 days and fine of Rs. 5000 U/S. 411, 414 & 461 IPC in default of payment of fine to undergo another 3 months simple imprisonment and Nyulosie Katiry was convicted U/S. 411 IPC on his own plea of guilt at the stage of consideration of charges.
According to the public prosecutor, UBSI Viketouzo of North P.S Kohima investigated the Case and submitted a Chargesheet on November 4, 2018 against the accused persons U/S. 302/ 392/ 201/ 411/ 414/ 471/ 482/ 483/ 34 IPC. Prosecution examined 32 witnesses to prove the case.
