SC Grants Anticipatory Bail to Congress Leader Pawan Khera

The Supreme Court on Friday granted relief to Congress leader Pawan Khera, allowing his anticipatory bail plea in connection with an FIR lodged by Assam Police over alleged remarks against Riniki Bhuyan Sarma, wife of Chief Minister Himanta Biswa Sarma. A Bench of Justices J.K. Maheshwari and Atul S. Chandurkar set aside the Gauhati High Court’s order denying pre‑arrest protection, stressing that while investigations must proceed with integrity, individual liberty under Article 21 cannot be jeopardised lightly. The apex court observed that the case appeared “politically motivated” and did not warrant custodial interrogation.

The court directed that Khera be released on anticipatory bail in the event of arrest, subject to conditions including cooperation with the investigation, refraining from influencing witnesses, and not leaving India without permission. It also noted errors in the Gauhati High Court’s reliance on provisions not invoked in the FIR. The FIR stems from Khera’s press conference allegations about Riniki Sarma’s foreign passports and assets, which she denied, calling the documents fabricated. The Supreme Court’s ruling underscores the need for objectivity and circumspection in criminal proceedings to prevent misuse of law amid political rivalry.
