Guwahati, Aug 18 (PTI): A Bangladeshi national has been expelled from Assam under the Immigrants (Expulsion from Assam) Act, 1950 by the District Magistrate of South Salmara-Mankachar following his conviction in a case related to illegal entry into India, an official said on Tuesday.
An order issued by South Salmara-Mankachar District Magistrate Parikishit Thoudam states that the Bangladeshi national has been expelled under Section 2(b) of the Immigrants (Expulsion from Assam) Act, 1950, that empowers the government to give directions regarding the removal and physical expulsion of a person or a group from India or Assam after an initial removal order has been issued.
According to an order issued on August 14 by the District Magistrate of the district, the foreign national has been identified as 24-year-old Mohammad Masood alias Mister, a resident of Ratanpur village under Rowmari police station in Kurigram district of Bangladesh.
BSF personnel apprehended him in the Jordanga BOP area on January 13 this year for allegedly entering India illegally and was subsequently handed over to Mankachar Police Station, where a case was registered against him under various sections of the BNS, the Immigration and Foreigners Act, 2025, and the Prevention of Damage to Public Property Act, 1984.
The district’s Additional Chief Judicial Magistrate, had subsequently convicted Masood on July 21 and sentenced him to one month, seven months and three months of simple imprisonment respectively under the provisions of the three Acts. The sentences would run concurrently, with set-off granted for the period already spent in detention.
The sentence term expired on August 12, after which he was shifted from District Jail, Dhubri, to the Matia Holding Centre in Goalpara for further action towards his deportation/repatriation to Bangladesh.
The district magistrate, in the order issued on August 14 and released to the media on Tuesday, observed that the offences involved unauthorised entry into India by damaging international border fencing and therefore had a direct bearing on border security and enforcement of immigration laws.
He also directed that the foreign national be removed from Assam’s territory within 24 hours of receiving the order, through the South Salmara-Mankachar/Dhubri route for lawful deportation or repatriation to Bangladesh by competent authorities.
He also directed the district’s Senior Superintendent of Police (Border) to capture the foreign national’s biometrics and demographic details on the Foreigner Identification Portal and ensure his removal.
Concerned authorities were also directed to take action regarding any Aadhaar card, electoral roll entry and ration card of the foreign national, and to take necessary steps concerning any movable or immovable property held by him.
