CPO contempt of court petition against MoRTH and state govt

The Chakhesang Public Organisation (CPO) has filed a contempt petition against Anurag Jain secretary Ministry of Road, Transport and Highways, Anurag Jain, Nagaland chief secretary J. Alam and executive engineer MoRTH regional officer (Civil) Guwahati, P. K. Meena for a non-compliance of the judgment and order dated January 1, 2023 passed by the High Court in PIL/09/2019.


The counsel for the petitioner submitted that the judgment and order of the court was dated 30.01.2023, wherein the court had held that the whole exercise for release of compensation to the petitioners for the damage or destruction within their landed property due to construction of road by the respondents should be completed within 6 (six) months. However, till date, no such compensation has been paid, it said.


Taking note of it, the judge justice Marli Vankung in her order stated that “there is a gross violation of judgment and order dated 30.01.2023, hence the contempt petition.” “This is an application filed under Section 11 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for a non-compliance of the judgment and order dated 30.01.2023 passed by this Court in PIL/09/2019,” the order stated.


Notice is to be issued upon the respondent through Registered Post with A/D within 3 (three) days returnable by three weeks, the order stated and listed the matter after three weeks.
