Two Plaintiffs who have raised the issue of educational qualification of chief minister T.R.Zeliang, have alleged “abuse of power for vested interests” as they have been summoned by the O.C North PS Kohima on fresh charges.
The duo- Maziezokha Nisa and Rokovisie Rino- had filed FIR under North PS in March 2015 over the a”false sworn affidavit” made by T.R.Zeliang for the 2013 assembly elections but that the Police Station, refused to file the FIR. They then approached the Gauhati High Court in the form of a writ petition for registering a criminal case but after hearings, the court dismissed the case on October 1,2015.
The duo stated that the hon’ble high court had closed the case after observing that furnishing of false affidavit before the Election Commission was a Cognisable Offence under Section 125-A of the Representation of People’s Act, but a non cognisable offence as per the provision of Section 154 of the Code of Criminal Procedure and also as laid down by the constitution bench of the Supreme Court.
However, they said that five months after closure of the case, they were surprised when the North PS on March 11,2016 summoned them for the same case, on March 17,2016 after registering a case much in contravention of the order of the Gauhati High Court which had closed the case on October 1,2015.
The duo responded to the summons, stating they would bring up the matter before the High Court and the CBI court first. They said the entire purpose of summons was to “compel us to withdraw our complaint before the Judicial Magistrate First Class Kohima, where honourable court has summoned T.R.Zeliang”.
