On the occasion of Republic Day, State Governor has remitted sentences against certain categories of prisoners who have been convicted by the courts (other than Court Martial) having criminal jurisdiction in the State of Nagaland and sentenced to rigorous imprisonment.
According to Home Department notification, the scale of remission for prisoners sentenced to 10 years and above is 30 days; prisoners sentenced to 5 to 10 years and above is 20 days; prisoners sentenced to 1 to 5 years is 10 days and prisoners sentenced upto 1 year is 5 days.
However, remission granted under the order would not be admissible to prisoners convicted under categories of Foreigners Act, Passport Act, Unlawful Activities (Prevention) Act, Section 3 to 10 of Officials Secrets Act 1923, Section 2 of Criminal Amendment Act 1961, Section 121 to 130 of IPC, Section 107/109 of CrPC, Prevention of Corruption Act, prisoners convicted of rape, attempt to rape or assault on women, convicted prisoners found violating jail rules and discipline, and foreign national convicted under any Acts. The remission order would take effect from January 26.
