Alt News co-founder Zubair arrested for hurting religious sentiments

Alt News co-founder Mohammed Zubair was arrested by the Delhi Police on Monday for allegedly hurting sentiments.
According to media reports, Zubair has been charged under Section 153 (Wantonly giving provocation with intent to cause riot—if rioting be committed—if not committed) and 295A (Outraging religious feelings of any class) of the Indian Penal Code.
“Today, during the course of investigation of a case registered u/s 153A/295A IPC against Mohammed Zubair, he joined in the investigation and after having sufficient evidence on record, he was arrested. He is being produced before the duty magistrate for seeking further PC remand,” said the police.

The police added that the case was registered based on a complaint regarding an offending tweet allegedly posted by Zubair.
“The said post of Mohd. Zubair containing picture and words against a particular religious community are highly provocative and done deliberately which are more than sufficient to incite hatred among people which can be detrimental for maintenance of public tranquility,” a senior Delhi police official said, adding that a case was lodged on the basis of a social media post by the complainant.
“During investigation, conduct of Mohd Zubair was found questionable, which warranted his custodial interrogation to unravel conspiracy in this matter. Accordingly, he has been arrested and is being produced before court for seeking police custody remand,” a senior police officer said.
No notice given: Pratik Sinha
Alt News co-founder Pratik Sinha tweeted that Zubai was called on Monday by the special cell “regarding probe in a 2020 case for which he already had protection against arrest from the High Court”.
“Around 6.45pm, we were told Zubair has been arrested in some other FIR for which no notice was given which is mandatory under law for the section under which he has been arrested. No FIR copy is being given to us despite repeated requests,” he added.
Zubair was reportedly one of the first people to tweet about Nupur Sharma’s controversial remarks about Prophet Mohammed. The issue snowballed into a global embarrassment for India as well as the BJP-led government. Sharma was eventually suspended from the party.
