Election Observer for Dimapur deputed by ECI, Suboth Singh, along with the Returning officers (ROs) s of 1-Dimapur I, 2-Dimapur II and 3- Dimapur III assembly constituencies will be undertaking inspection of election accounts register on February 14, 20 and 24 at 11 a.m. DC office, Dimapur.
In this connection, all the candidates under 1-Dimapur I, 2- Dimapur II and 3- Dimapur III Assembly Constituencies have been informed to furnish day to day accounts of expenditure by the contesting candidates (Annexure- E 1) for inspection by EO and Returning Officers.
According to DIPR report, the candidate will be required to produce the register either in person or through his election agent or any other person duly authorized by the candidate before the expenditure observer/ designated officer for inspection at least three times during the campaign period.
If a candidate or his agent does not produce his election expenditure register for inspection on the day fixed for this purpose, a notice shall be issued to the candidate by the RO in writing, that repeated failure to produce the register for inspection on the specified day in the notice, it shall be presumed that the candidate has failed to maintain a day to day account of election expenditure as required under Section 77 of RP Act 1955.
If the candidate does not produce the register after three days of serving of the notice, the permission given to the candidate for use of vehicle during election shall be withdrawn and the withdrawal of permission for the use of vehicle shall be intimated to all the Surveillance teams and Flying Squads and displayed on the notice board.
Despite of the notice, if the candidate failed to produce the register of election expenditure for inspection, a complaint under Section 171-1 of IPC shall be filed in the competent court.
