A man was convicted by Fast Track Special Court (POCSO) Dimapur on Tuesday for raping a minor girl has been sentenced to 20 years rigorous imprisonment under Section 376 AB and imposed a fine of Rs 10,000. If the convict defaulted payment of fine, the court ruled that he would undergo rigorous imprisonment for eight months.
Special judge under PoCSO Act Khrulto Koso found Izierangbe Yalie of Bank Colony Dimapur guilty under sections 376 AB, 376 (2) (f) (i) (m) of Indian Penal Code (IPC), 1860 and under Section 6 of Protection of Children from Sexual Offences (PoCSO) Act, 2012 vide section 235 (2) of Code of Criminal Procedure.
As per the order, Yalie was also found guilty under Section 376 (2) ) (f) (j) (m) of IPC and sentenced to 10 years rigorous imprisonment and imposed Rs 10,000 as fine and a rigorous imprisonment of one year in case of default in paying the fine.
He was further found guilty under Section 6 of PoCSO Act and sentenced to 20 years rigorous imprisonment and imposed a fine of Rs 10,000 and one-year rigorous imprisonment in case of default. The special judge ordered that all sentences would run concurrently. The crime came to light after an FIR was received by Childline on July 9, 2021 and victim was the niece of the perpetrator
Since the accused had not gone on bail, the court ruled that there was no question of discharging his bail bond, though he had been informed of his right to appeal. As there was no property/documents recovered as per the list of articles seized, no order was issued to that effect.
Out of the amount of fine, if paid any by the accused or realised, Rs 15,000 would be given to the victim on due verification for defraying the expenses of prosecution as provided under Section 357(1) (a) Criminal Procedure Code. The payment of such fine was however subject to conditions laid down in Section 357(2) of Criminal Procedure Code.
By invoking provisions of Section 357-A (2) (3) Criminal Procedure Code, the court asked Dimapur Legal Services Authority to initiate necessary steps to compensate the victim from the Compensation Scheme for Women Victim/Survivors of Sexual Assault/other Crimes, 2018 sanctioned by the Home Department, Relief & Rehabilitation, Nagaland.
