Encroachment literally means the act of slowly taking or using space, time, or rights that belongs to someone else. It often happens little by little without permission. In legal sense an encroachment is an unauthorized physical intrusion or trespass where a person builds, extends or place of a structure, fence, or tree onto a neighbors private land or public property without permission. It violates property boundary lines and often leads to legal disputes over land ownership.
Types of Encroachment :
- Private Encroachment : A structure (like a roof, fence, or driveway)crosses the property line onto a private neighbor’s land.
- Public Encroachment: Private construction or occupation spills over onto government property, public roads or sidewalks.
- Structural Encroachment : Major permanent elements-such as extra room, balcony, or foundation slab- breach official limits.
Urban and Public Space Encroachment today : In town and cities occupation of public land such as footpath, roads and common has reached critical levels threatening pedestrian safety and urban development infrastructure.
Supreme Court directives : The Supreme Court directed the Centre to ensure that every road has a properly demarcated and encroachment-free space for pedestrians and for other developmental activities.
State Crackdowns : Municipal bodies face an ongoing struggle to balance hawker livelihoods with the need for clear thoroughfares. In some states authorities executed drives targeting unauthorized roadsides stalls, mandated spot fines and regulations to keep at least two third of pavements open.
Impact of Encroachment Today :
• Encroachment today acts as a major catalyst for environmental degradation, climate vulnerability and civic paralysis. It worsen natural disasters by blocking critical waterways increases the erosive forces, depth and velocity of flash floods, causing catastrophic damage to nearby communities.
• With footpaths overtaken, walkers –especially children and senior citizens –are forced onto the main traffic lanes, escalating the risk of severe accidents.
• Narrowed carriageways restrict vehicle flow, turning local streets into severe bottlenecks during peak hours. Especially during times of Medical emergency , House fire, Natural disasters, etc. Ambulance , Fire engines and Police struggle to navigate or pass through constricted, illegally blocked streets, putting lives in danger. Who is responsible for this ? “as a concern citizens lets answer this to ourselves”.
Responsibility of a Citizen:
• Citizens should voluntarily comply with property boundaries and proactively report illegal occupation on public common lands to authorities.
• Voluntary land donation or sacrificing small plot is vital for road widening and clearing encroachments to improve mobility is way of having civic sense of residents which is the need of the hour.
• Proper waste management decreases encroachment by reclaiming illegally dumped sites, reducing the footprint of sprawling municipal landfill, and curbing the “not-in-my backyard” (NIMBY) real estate disputes.
• Construction and infrastructure should reflect “Civic sense” must serve, respect and integrate into the community rather than unlawfully extending into public spaces or inconveniencing the public.
• Encroachment whether it involves property, public spaces or the rights of others- is frequently considered a moral and ethical transgression.
