DIMAPUR, JUN 11 (NPN): Nagaland Police has issued instructions to all police stations and district police units not to register FIRs in purely civil or commercial disputes, including cases involving recovery of business dues, trade credits, loans and contractual breaches, unless there is clear evidence of fraudulent or dishonest intention at the inception of the transaction.
In a circular issued on June 10, Police Headquarters said the directive was based on a series of Supreme Court judgments aimed at preventing misuse of criminal law for settling civil and commercial disputes. According to a press note from PRO, PHQ, station house officers (SHOs) and officers-in-charge have been directed to scrutinise complaints involving business dues, loans and contractual matters and conduct a preliminary enquiry, as mandated under the BNSS, where criminality is not apparent.
If a complaint discloses only a civil dispute, complainants would be advised to seek appropriate remedies through civil courts.
