National Peoples’ Party (NPP) has challenged the order of Nagaland Legislative Assembly (NLA) speaker before the Supreme Court for approving the merger of two of its legislators with Nationalist Democratic Progressive Party (NDPP).
In this regard, NPP has filed a Special Leave Petition before the Supreme Court (no. 12164-2019) on April 2.
The two NPP legislators- Imnatiba Jamir and L. Khumo Khiamniungan had merged with NDPP on March 20.
According to NPP, the order of speaker on March 20 was in gross violation of paragraph 4 of 10th Schedule of the constitution. The party pointed out that the speaker’s order was also in gross violation of principle of natural justice as no notice was served to it before prior to passing of the order.
Further, there was no merger of original political party (NPP) with NDPP, the petition added.
In a release, NPP explained that it had approached the apex court directly as it believed that violation of paragraph 4 of the 10th Schedule of the constitution by the speaker and also by the two legislators elected on its symbol should be heard and decided expeditiously.
Besides going against the provisions of 10th Schedule, the party also accused the speaker of acting in a partisan and unfair manner, contrary to the provisions of the constitution.
The petition is likely to be heard at an early date, the release added.
