ACAUT Nagaland along with Public Service Aspirants Nagaland (PSAN) have filed a Public Interest Litigation (PIL) in the Gauhati High Court, Kohima Bench on three issues in connection with backdoor appointments.
In a joint statement, ACAUT and PSAN said the PIL was filed to quash and set aside the appointment of 51 backdoor appointees appointed against NPSC posts. Since the appointments were made after the June 6, 2016 court judgement, banning backdoor appointments, ACAUT and PSAN pointed out that such appointments were contempt of court.
It further appealed to the court to quash the Office Memorandums 4/8/2008 and 11/8/2016 which empowers the government to regularize all backdoor appointments after three years of service. They said such action was in total contravention of the Supreme Court judgment, as passed in Umadevi Case (2006) which states that backdoor door appointment is illegal and ultravires of the Constitution. The two bodies also sought for termination of services of all 655 backdoor appointments made against NPSC posts, which were carried out between the Umadevi judgment of 2006 and Gauhati HC order, Kohima, dated 6/6/16.

If not, they said all the 705 (655+51) posts should be requisitioned to the NPSC for general recruitment through open competitive examination and to submit the detailed status report of the 705 backdoor appointees before the Court.
Meanwhile, ACAUT and PSAN have reminded that the court has stayed/suspended the most contentious Office Memorandums 4/8/2008 and 11/8/2016 till the PIL was disposed off.
Also, they said the 51 backdoor appointees have been directed to appear before the Court as respondents, which were published in the newspapers with names.
Therefore, they cautioned that any department trying to appoint or in the process of regularizing posts will be held contempt of court.
